If the seller knows there is something major wrong with the property then these items must be disclosed in the seller disclosures.

Seller Disclosures

You probably inspected the property to a certain degree when you looked through the home with your agent. But the best person to tell you about any problems is the seller. The seller disclosures are designed to inform you of any major problems at the earliest possibility after the offer has been accepted. If there is something in these at you don't like then you have the right to cancel the contract.

These disclosures are mandatory in Utah (they may or may not be in other states) and if you are using an agent this will be taken care of automatically. If you are buying from a FSBO and you are not represented by a Realtor then you will need to request these from the seller.
